• No unlawful, fraudulent, or abusive activity is permitted.
• You may not attempt to gain unauthorized access to any system or network.
• Automated data collection, scraping, or harvesting is strictly prohibited.

4. Emergency Services

The Services are not a replacement for a traditional phone line and do not support emergency calls to 112, 911, 999, or any other emergency number. You must ensure you have an alternative means of contacting emergency services. BoraPhone is not liable for any loss arising from the inability to place emergency calls through the Services.

5. Fees and Payment

Certain features of the Services may require payment of fees. You agree to pay all fees and applicable taxes in accordance with the pricing and billing terms presented to you for the Services. We may change our fees at any time by providing notice through the Services or by other reasonable means.

6. User Responsibilities

You are solely responsible for all activity that occurs under your account and for any content transmitted through the Services. You agree that you will:

• Comply with all laws applicable to your communications and data processing.
• Obtain all necessary rights and consents before uploading or sharing content.
• Respect the privacy and data rights of individuals you contact using the Services.
• Not use the Services for spam, robocalls, automated or bulk dialing, harassment, or any fraudulent or unlawful purpose, including artificially generating traffic to premium-rate or high-cost destinations.
• Obtain any consent required by law before recording or transcribing a call.
• Keep your account credentials secure; you are responsible for all charges incurred through your account, including through unauthorized use, until you notify us.

We may suspend or terminate your account, block destinations, and withhold refunds or credits if we reasonably suspect fraud, abuse, or a violation of these Terms. Credit is non-transferable and, except where required by law or under our refund policy, non-refundable.

7. Third-Party Services and Integrations

The Services may provide access to third-party products, services, or integrations. We do not control and are not responsible for any third-party content, policies, or practices. Your use of third-party offerings is subject to the separate terms and conditions of those providers.

8. Intellectual Property Rights

All intellectual property rights in and to the Services and their content are owned by BoraPhone or our licensors. Except as expressly permitted, you may not copy, modify, distribute, sell, or lease any part of the Services. You retain ownership of any content you submit through the Services, but grant us a limited license to host and use that content as necessary to provide the Services.

9. Disclaimers

The Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory. We disclaim all implied warranties, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted, secure, or free from errors. Call quality, connectivity, and availability depend on third-party carriers and networks, your internet connection, and your device, none of which we control. We do not guarantee that any call will connect or that any phone number will be available.

10. Limitation of Liability

To the maximum extent permitted by law, BoraPhone and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of or inability to use the Services. To the maximum extent permitted by law, our total aggregate liability for all claims arising out of or relating to the Services will not exceed the amount you paid to BoraPhone in the twelve (12) months before the event giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

11. Indemnification

You agree to indemnify, defend, and hold harmless BoraPhone, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the Services.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of Spain.

13. Changes to the Terms

We may update these Terms from time to time to reflect changes in our practices, legal requirements, or the Services. When we make material changes, we will provide reasonable notice through the Services or other appropriate channels. Your continued use of the Services after any update constitutes acceptance of the revised Terms.
